These Terms and Conditions (“Terms”) govern the rental of event items and services provided by Emerise by Tutubah (“Company,” “we,” “our”) to the Client (“you,” “your”). By confirming a booking, making a payment, or signing a rental agreement, you acknowledge that you have read, understood, and agreed to these Terms.
1. Rental Items & Services
Emerise by Tutubah offers the rental of (but not limited to):
  • 360° Photo Booth
  • Audio Guestbook (Vintage Telephone Booth)
  • Event Chairs & Tables
  • Luxury Furniture & Décor Items
  • Lighting, Linen, and Other Accessories

A detailed list of rented items will be included in your invoice or rental agreement.

2. Booking & Payment Terms
1. Booking Confirmation
  • A booking is only confirmed once a signed agreement and the initial payment are received.
  • Without confirmation, items remain available to other clients.
2. Deposit
  • A 50% non-refundable deposit is required to secure your booking.
  • The remaining 50% balance must be paid at least 7 days before the event date.
3. Late Payment
  • Late payment of the balance may result in cancellation of your booking or a 10% late fee surcharge added to your total invoice.
4. Accepted Payment Methods
  • Mobile Money, Bank Transfer, or Cash (where applicable).
3. Delivery, Setup & Collection
  • Delivery, setup, and collection will be handled by our team unless otherwise agreed in writing.
  • Delivery fees apply and are based on event location, accessibility, and size of the order.
  • The client must ensure the venue is accessible, with sufficient time allowed for setup and dismantling.
  • If our team experiences delays due to venue access restrictions (locked gates, no loading space, etc.), additional waiting time charges may apply (on a per-hour basis).
4. Use of Rental Items
  • All items are for event rental use only and remain the property of Emerise by Tutubah.
  • Clients are responsible for ensuring proper care and handling of rented items during the rental period.
  • No alterations, defacement, or misuse of items is permitted (e.g., standing on tables, moving heavy furniture without approval).
  • Electrical items such as the 360° booth or lighting must only be used with proper power sources.
5. Changes, Rescheduling & Surcharges
  1. Client-Initiated Changes
  • Changes to booking (items, event date, venue, or time) must be requested in writing.
  • Changes are subject to availability and may attract additional charges.

2. Extended Rental Period

  • Rentals are for the agreed event hours only.
  • If items are required beyond the agreed time, overtime charges will apply (hourly or daily rate, depending on item).
3. Rescheduling
  • If the event is rescheduled, the deposit may be applied to the new date (subject to availability).
  • Rescheduling less than 72 hours before the event may incur a surcharge of 20% of the total booking fee.
4. Last-Minute Changes
  • Any changes made within 48 hours of the event (venue, timing, or additional items) may attract a rush surcharge of 15% – 30% of the booking fee.
6. Cancellation Policy
  • Deposits are non-refundable.
  • Cancellations made 14 days or more before the event will receive a refund of any balance paid (excluding the deposit).
  • Cancellations made less than 14 days before the event will forfeit all payments made.
  • If the Company cancels due to unforeseen circumstances, a full refund (including deposit) will be issued, and we will assist in recommending alternatives.
7. Damage, Loss & Liability
  • The Client assumes full responsibility for any damage, theft, or loss of rental items during the rental period.
  • If items are damaged, lost, or stolen, the Client will be charged the full replacement value or repair cost.
  • A refundable security deposit may be required at the Company’s discretion.
  • The Company shall not be liable for injury, accident, or damage to property caused by misuse or negligence of the Client, guests, or venue staff.
8. Force Majeure

The Company is not responsible for delays, cancellations, or failure to deliver services caused by circumstances beyond our control (natural disasters, strikes, pandemics, severe weather, government restrictions, etc.). In such cases, bookings may be rescheduled without penalty, subject to availability.

9. Governing Law

These Terms are governed by the laws of the Republic of Ghana. Any disputes shall be resolved amicably, failing which they shall be subject to the jurisdiction of Ghanaian courts.
 
10. Agreement
By booking with Emerise by Tutubah, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
